The Demise of the 28-Point Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension triggered by the announcement of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A American diplomat spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its countermove: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the outgoing year. By day, political struggles are fought: positive announcements are issued from various governments. Considerable effort is devoted on restraining certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "settlement".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track missile launches from across the border, a capacity enabled by current data. From witness perspectives, military aircraft that had been scrambled to engage hostile aerial threats flew past – advanced fighter aircraft supplied to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: several firings deployed against a incoming threat. This was a modern interception technology at work, most likely provided by partner states. Every firing shakes the surroundings, causing tremors. The moment of terror quickly transforms into sober acceptance: perhaps the approaching threat won't cause damage this time, sparing the city from devastation and further power outages.

Persistent Threats

Not long after, a large-caliber weapon engaged a drone somewhere nearby, part of a rapid response unit – probably Western-made equipment. Regrettably, the projectiles didn't strike the opposing UAV – it maintained course toward its destination.

With pauses, this carried on until dawn. Kyiv greeted the daybreak reports: several casualties, destruction and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still went about their day – living the war. But those entire period illustrated Ukraine's essential dependence on international aid – a dependence that regional partners are evidently unprepared to replace in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, controversy and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and multilateral gatherings.

Every new proposal from Washington follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually win the battle. This cycle will, certainly, persist.

Strategic Calculations

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration functions according to a principle familiar among experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government presumes that it is unfeasible to force Russia to surrender the territory that it already controls in Ukraine's occupied territories.

The problem is that while acknowledging this situation, Washington does nothing to prevent Kremlin actions, through diplomacy or military means, from thinking that the situation will not shift further in its favour in the months ahead.

Opposing Positions

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its allies are approaching exhaustion. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to end hostilities, but they will continue as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, progressively conceding civilians and areas but averting a entire defensive failure until conditions improve in its advantage.

Current Realities

Objectively, there are no genuine requirements for a truce. Now, personal considerations are coming into play: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any plan Kyiv finds unsuitable, so that their focus does not switch to homefront challenges. And although their task will now be considerably more difficult after latest incidents, it remains quite doubtful that this will modify their basic position.

These opposing factors are driving the talks.

Summary and Prospects

It took a mere seven days to kill the 28 points of the current initiative. Assertive and inconsistent approach of the matter by Washington, opposition by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, recent disclosures, all served their function.

While new proposals based on established approaches are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and reflect certain reluctance to modify developments, if they stand together and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the coming months, mainly require continued Western support.
